Terms of Service

These Terms of Service apply to the New Move Massage website, appointment requests, onlinescheduling, purchases, and services. By using this website, booking or requesting an appointment, purchasing a service or gift card, or accepting these terms during checkout, you agree to these Terms of Service. If you do not agree, please do not use the website or complete a purchase.

About New Move Massage

New Move Massage is operated by Cindy Gagliardi, a licensed massage therapist, at 1450 East St.,Suite 8, Pittsfield, Massachusetts 01201. Services are provided by appointment only. New Move Massage may be contacted at 413 446 1092 or through the contact form at www.newmovemassage.com.

Services

New Move Massage offers customized massage and bodywork that may include therapeutic massage, myofascial techniques, somatic awareness, craniosacral informed techniques, breath awareness, assisted stretching, mobility work, guided movement, and other enhancements described during the booking and consent process. Available services, durations, prices, and inclusions may change. The information shown on the applicable booking or checkout page at the time of purchase will control, subject to any written series or membership agreement. Services are educational and wellness oriented. They do not create a physician patient relationship and do not replace medical evaluation, diagnosis, mental health care, physical therapy, or emergency care.

Appointments and Confirmation

Submitting a contact form or appointment request does not create a confirmed appointment. An appointment is confirmed only after New Move Massage or its scheduling provider sends confirmation. Clients are responsible for providing accurate contact information and reviewing appointment details, preparation instructions, and policies.

Payment

Prices are stated in United States dollars. Payment is due as shown at booking, checkout, or in the applicable service agreement. New Move Massage accepts cash, credit cards, and Venmo. New Move Massage may use third party providers, including Square and Venmo, to schedule appointments, process payments, and issue gift cards. Those providers may apply their own terms and privacy practices. Clients

authorize the applicable charges they approve during booking or checkout. Any mandatory fee will be disclosed before payment when required by law. Taxes, if applicable, will be shown at checkout. A failed or disputed payment may result in suspension of future booking privileges

until the account is resolved.

No Refund Policy

All sales are final. Payments for services, prepaid series, memberships, and gift cards are nonrefundable and will not be returned because of a change of mind, unused sessions, missed appointments, scheduling conflicts, dissatisfaction with an individual response, or failure to complete a prepaid series. New Move Massage may offer a rescheduled appointment or account credit in its sole discretion, but is not required to do so. This policy does not limit a refund or other remedy that New Move Massage is legally required to provide.

Cancellation, Rescheduling, and Missed Appointments

Please provide at least 12 hours notice to cancel or reschedule an appointment. Cancellations made with less than 12 hours notice and missed appointments may be charged a $55 fee. The fee may be charged to the payment method authorized for the appointment or invoiced separately, consistent with the disclosure and authorization provided at booking.

New Move Massage may waive or modify the fee in its reasonable discretion for emergencies or unusual circumstances. If New Move Massage must cancel an appointment, the client will not be charged for the cancelled service and any payment collected for that appointment will be refunded or credited, as agreed with the client.

Late Arrival

Clients who arrive late may receive a shortened session so the next appointment can begin on time. The full scheduled price may still apply. If the remaining time is not sufficient to provide the service safely or appropriately, the appointment may be treated as a late cancellation.

Prepaid Series and Programs

A prepaid series or program, including Move Free, must be paid for as stated at purchase and completed within the timeframe disclosed on the service page, booking page, receipt, or written agreement. Standard cancellation and missed appointment rules apply to appointments scheduled through a prepaid series. A late cancellation or missed appointment may result in the $55 fee rather than the loss of a full session, unless a different written agreement applies. A prepaid series or program is intended for the purchasing client and may not be transferred or shared

unless New Move Massage agrees in writing. Completion does not guarantee a particular result.

Memberships

Any membership is governed by the membership agreement presented at enrollment, including its price, commitment period, billing date, rollover terms, household sharing terms, upgrades, cancellation process, failed payment terms, and any enrollment limitations. If these Terms of Service conflict with a signed or electronically accepted membership agreement, the membership agreement controls for the membership. Recurring charges will be made only as disclosed and authorized at enrollment. Instructions for cancellation must be provided with the membership agreement and made available upon request.

Gift Cards

Gift cards may be used for eligible services offered by New Move Massage, subject to applicable law and any clearly disclosed restrictions. Gift cards are not redeemable for cash except where required by law. Lost, stolen, or improperly used gift cards may not be replaceable. Any expiration or fee will apply only when permitted by Massachusetts law and clearly disclosed at purchase.

Client Responsibilities and Health Information

● Provide complete and accurate health information that may affect the safety or appropriateness of a service.

● Tell the therapist about pain, injuries, pregnancy, recent surgery, medications, allergies, medical conditions, or changes in health before the session.

● Communicate preferences, discomfort, pressure concerns, and boundaries during the session.

● Stop or decline any technique at any time.

● Seek medical attention for urgent, severe, unexplained, or worsening symptoms.

New Move Massage may postpone, modify, or decline a service when it may be unsafe, outside the therapist's scope, or otherwise inappropriate. Website acceptance of these Terms does not replace the separate health intake and informed consent process required before hands on or guided services.

Professional Boundaries and Conduct

All services are strictly professional and therapeutic. New Move Massage has zero tolerance for sexual solicitation or sexual conduct of any kind. Sexual comments, requests, jokes, gestures, intentional exposure, touching of the therapist, harassment, threats, discrimination, intoxication, unsafe conduct, or any other boundary violation are prohibited. If a client engages in prohibited conduct, the session will end immediately, the client will be charged the full scheduled price, future services may be refused, and law enforcement or other appropriate authorities may be contacted. New Move Massage may take any additional action reasonably necessary to protect safety and comply with law.

Minors

Services for a person under 18 require advance approval from New Move Massage and consent from a parent or legal guardian. New Move Massage may require the parent or guardian to remain on the premises or in the treatment room. Additional rules may apply based on the service and the minor's age.

Communications

Clients may receive communications needed to respond to inquiries, confirm or manage appointments, provide service related information, or address transactions. Marketing email is optional. A client may unsubscribe from marketing email at any time by using the unsubscribe method provided in the message or by contacting New Move Massage. Unsubscribing from marketing does not prevent necessary appointment or transaction communications.

Website Use

The website and its original text, graphics, branding, and other content are owned by or licensed to New Move Massage and may not be copied, republished, sold, or used commercially without permission. Clients may use the website for personal, lawful purposes. They may not interfere with the website, attempt unauthorized access, submit false information, or use the website in a way that harms New Move Massage or another person.

Third Party Services and Links

The website may link to scheduling, payment, gift card, social media, mapping, or other outside services. New Move Massage does not control those services and is not responsible for their availability, content, security, or privacy practices. Use of an outside service is subject to that provider's terms and policies.

No Guarantee of Results

Each person responds differently to massage, bodywork, movement, and breath based practices. New Move Massage does not promise that a service will eliminate pain, correct a condition, restore a particular range of motion, or produce any other specific result. Client testimonials describe individual experiences and are not guarantees.

Limitation of Website Liability

To the fullest extent permitted by law, New Move Massage is not responsible for indirect, incidental, special, or consequential losses arising solely from use of or inability to use the website or third party

Changes to These Terms

New Move Massage may update these Terms from time to time. The effective date will be revised when changes are posted. Material changes affecting an existing prepaid series or membership will be handled according to the applicable agreement and law rather than applied retroactively in a way that removes already purchased rights.

Governing Law and Contact

New Move Massage will not disclose these records except with your authorization or as permitted or required by law. New Move Massage may not be a covered entity under the federal Health Insurance Portability and Accountability Act. Movement and Breath Based Practices

Movement, mobility, somatic, and breath based practices are offered for general wellness and education. Participation is voluntary. Clients should move and breathe within a comfortable range and stop if they experience pain, faintness, chest pain, unusual shortness of breath, numbness, severe distress, or another concerning response. More intensive breathwork may not be appropriate for everyone and requires separate screening, explanation, and consent before participation.

Before Your Appointment

New Move Massage is located at 1450 East St., Suite 8, Pittsfield, Massachusetts 01201. Please use the rear entrance behind GAME Fitness. The entrance and studio are handicap accessible, and there are no stairs.

Arrival

Please arrive about five minutes before your scheduled appointment. If my treatment room door is closed, I am finishing with another client. Please have a seat in the waiting room, and I will greet you as soon as I am available. Please do not knock or enter the treatment room while the door is closed unless there is an emergency.

What to Wear

Wear comfortable clothing, especially when your appointment includes a posture, movement, or mobility assessment. During hands on bodywork, you may undress only to your personal comfort level. You will be appropriately draped, and you may ask questions or request adjustments at any time.

Bathroom

A bathroom is available. You are welcome to use it before or after your appointment. Preparing for Your Session

● Complete any requested intake and consent forms before your appointment when possible.

● Avoid arriving under the influence of alcohol, cannabis, or another impairing substance.

● Avoid a large meal immediately before your session.

● Tell me about injuries, recent surgery, pregnancy, medications, allergies, medical conditions, or

changes in your health.

● Share your goals, comfort level, pressure preferences, and any areas you do not want addressed.

During Your Session

Your comfort, consent, and boundaries matter throughout the appointment. Please speak up if you would like more or less pressure, a change in positioning, additional draping, a technique stopped, or the session ended. You may decline any technique at any time.

Professional Environment

All services are strictly professional and therapeutic. Sexual solicitation or sexual conduct of any kind is prohibited under a zero tolerance policy. Any violation will end the session immediately. The client will be charged the full scheduled price, future services may be refused, and law enforcement or other appropriate authorities may be contacted.
